Makerspace Use Agreement

This Makerspace Use Agreement (“Agreement”) covers your use of the FundedYouth physical makerspace at 415 Parkway Plaza, Suite 519, El Cajon, CA 92020 (the “Makerspace”) and the equipment, tools, and materials located there.

This Agreement is in addition to FundedYouth’s General Release Agreement (liability waiver) and is required from every person who uses the Makerspace, whether enrolled in a class, attending an open lab, mentoring a competition team, or visiting as a guest.

FundedYouth is a 501(c)(3) educational nonprofit registered in California (EIN 93-4090260).

[!NOTE] For participants under 18, this Agreement must be signed by both the participant and a parent or legal guardian. The signing parent agrees to be bound by all provisions of this Agreement on behalf of the minor.

The Makerspace contains equipment that can cause serious injury, including but not limited to:

  • 3D printers with heated extruders (200–300 °C) and heated build plates (up to 110 °C)
  • Resin printers that use photopolymer resin (irritant; some users are sensitized)
  • Laser cutters with high-power lasers that can cause burns, fires, or eye injury ([ATTORNEY REVIEW] — confirm presence)
  • Soldering irons and small electronics tools
  • Hand tools (screwdrivers, knives, files)
  • Power tools ([ATTORNEY REVIEW] — list if any, e.g. rotary tools, drill presses)
  • Chemicals (isopropyl alcohol, solvents, adhesives, paints)
  • Filaments, resins, dust, and fumes that may cause respiratory irritation
  • Robotics and electronics (batteries, motors, sharp prototype parts)

You understand that even with reasonable safety precautions, accidents can happen. You assume the risks inherent in working with this equipment.

You agree to:

  1. Listen to staff and instructors. Follow all instructions from FundedYouth staff, instructors, and volunteers without delay.
  2. Sign in. Sign the visitor log on entry. Wear any required identification or wristband.
  3. Use only equipment you are authorized to use. Each piece of major equipment requires a brief safety briefing first. Do not operate equipment you have not been cleared on.
  4. Wear appropriate clothing. Closed-toe shoes are required. Long hair must be tied back when using any spinning, heating, or cutting equipment. No loose sleeves or jewelry near moving parts.
  5. Use personal protective equipment (PPE). Safety glasses are required when operating laser cutters, when grinding, or when handling resin. Gloves are required when handling resin or hot parts. Respirator/mask required when sanding or working with solvents in poorly ventilated areas. PPE is provided.
  6. Stay supervised if under 18. A FundedYouth instructor, mentor, or your parent/guardian must be on-site while you use the Makerspace. You may not use the Makerspace alone if you are under 18.
  7. No food or drink at workstations except sealed water bottles. No food near resin, solvents, or 3D printers.
  8. Clean up. Return tools to their storage locations. Wipe down workstations. Dispose of waste in the correct containers (regular trash, resin waste, sharps, recycling).
  9. Report problems. Report broken equipment, injuries, near-misses, missing tools, or unsafe conditions immediately to staff.
  10. Respect others. Follow the FundedYouth Code of Conduct (separate document) at all times.

You agree NOT to:

  • Use the Makerspace while impaired by alcohol or drugs
  • Bring weapons of any kind onto the premises
  • Bring or use combustibles or hazardous materials not provided by FundedYouth (e.g. personal solvents, flammable liquids beyond personal isopropyl alcohol, lithium batteries outside approved kits)
  • Modify, bypass, or disable safety guards, interlocks, or ventilation systems
  • Print or fabricate items that violate the law (functional firearm components, drug paraphernalia, items that infringe others’ intellectual property)
  • Print or fabricate items that violate community standards (sexually explicit content, content promoting violence or hate)
  • Take FundedYouth-owned tools, equipment, filaments, or supplies off-site without written permission
  • Operate equipment outside posted hours of operation
  • Bring unauthorized guests onto the premises

You agree to disclose to FundedYouth any:

  • Allergies (especially to resin, latex, dust, or solvents) that could affect your safety
  • Medical conditions that staff should know about in case of an emergency (epilepsy, severe asthma, diabetes requiring rapid response, etc.)
  • Medications you take that could affect your judgment around machinery

For minor participants, disclosure is the parent or guardian’s responsibility, and FundedYouth treats medical information confidentially.

In the event of injury or medical emergency, FundedYouth will:

  1. Provide immediate first aid and call 911 if appropriate
  2. Notify the emergency contact on file (and parent/guardian for minors)
  3. Document the incident
  4. Cooperate fully with any subsequent investigation

You authorize FundedYouth to obtain emergency medical care for you (or for your minor child) if you are unable to consent at the time.

[ATTORNEY REVIEW] Verify the language above is compatible with the existing General Release Agreement and California Good Samaritan / emergency-consent law.

Members and class participants may use printers during scheduled lab time. Member printer rates apply (see portal pricing). Each print must be:

  • Submitted through the FundedYouth queue/check-in process
  • Within the size and material limits of the chosen printer
  • Free of obvious failure modes (severe overhangs, unsupported geometry, etc.)
  • Compliant with Section 3 (no prohibited items)

FundedYouth may decline any print at our discretion.

5.2 Failed prints, abandoned prints, and unattended prints

Section titled “5.2 Failed prints, abandoned prints, and unattended prints”
  • Long prints may be left running unattended only if approved by staff and the printer is on the approved overnight list.
  • Failed prints are the user’s responsibility. The user may be charged for filament used in the failed attempt.
  • Prints not picked up within 14 days become FundedYouth property unless other arrangements were made.

You may use FundedYouth-supplied filaments and resins. You may bring your own only with prior staff approval; bringing exotic, non-standard, or non-certified materials without approval is grounds for revocation of access.

You agree to:

  • Treat equipment with reasonable care. Normal wear and tear is expected and FundedYouth’s responsibility.
  • Pay for damage caused by your negligence or willful misconduct. This includes broken nozzles caused by improper bed leveling, damaged tools caused by misuse, etc. Cost will be limited to actual repair or replacement cost.
  • Pay for damage caused by violating this Agreement. Including but not limited to operating equipment without authorization, ignoring staff instructions, or bringing unauthorized materials.

For minors, the signing parent or guardian agrees to be financially responsible for damage caused by the minor.

[ATTORNEY REVIEW] Set a dollar cap (e.g. “Total liability for damage by any single participant in any 12-month period will not exceed $[ATTORNEY REVIEW]”). Without a cap, minor accidents could create disproportionate liability.

  • You bring personal items at your own risk. FundedYouth is not responsible for lost, stolen, or damaged personal property brought onto the premises.
  • Lockers and storage are provided where available, on a first-come-first-served basis, for short-term project storage.
  • Long-term storage of personal projects requires staff approval.

FundedYouth may take photos and video at the Makerspace for educational, archival, marketing, and reporting purposes. The Photo / Media Release (separate document) governs how those photos and videos may be used.

You agree not to record other participants (especially minors) without their and their parent’s/guardian’s consent.

FundedYouth may suspend or revoke your Makerspace access at any time, with or without cause and with or without notice, including but not limited to violations of:

  • This Agreement
  • The General Release Agreement
  • The Code of Conduct
  • Applicable laws

If your membership and access are terminated:

  • Unused FYBITS remain in your wallet but cannot be spent (membership is required to spend credits; see portal agreements)
  • Refund of any prepaid amounts is at FundedYouth’s discretion
  • Any unfinished projects must be picked up within 14 days

You acknowledge that FundedYouth does not provide medical, dental, or property insurance to participants. You are responsible for your own insurance coverage.

By signing, you assume all risks of Makerspace use that are not the result of FundedYouth’s gross negligence or willful misconduct.

This Agreement supplements, and does not replace:

  • The General Release Agreement (liability waiver) — must also be signed
  • The Code of Conduct — applies to behavior in all FundedYouth contexts
  • The Photo / Media Release — governs use of your image
  • Any Portal agreements — govern your portal account, FYBITS, and subscriptions

If there is a conflict between this Agreement and another agreement, the agreement that is more specific to the situation in question controls.

This Agreement is governed by the laws of the State of California. Any disputes will be resolved in the state or federal courts located in San Diego County, California, after first attempting informal resolution by emailing info@fundedyouth.org.

[ATTORNEY REVIEW] Align with the dispute-resolution choice made in the Terms of Service (arbitration vs. courts).

FundedYouth may update this Agreement from time to time. We will:

  • Post the updated Agreement at docs.fundedyouth.org/legal/makerspace-use-agreement/
  • Notify active participants by email
  • For material changes, require re-signature before continued Makerspace access

By signing below, you confirm that you (or, for minors, the signing parent or guardian on behalf of the minor):

  • Agree to be bound by it
  • Have had an opportunity to ask questions
