Photo and Media Release

This Photo and Media Release (“Release”) governs FundedYouth’s use of photographs, video, audio recordings, and other media that include your image, voice, name, or likeness, captured in connection with FundedYouth programs and activities.

FundedYouth is a 501(c)(3) educational nonprofit registered in California (EIN 93-4090260).

[!NOTE] For participants under 18, this Release must be signed by a parent or legal guardian on the minor’s behalf.


I (the “Releasor”) grant FundedYouth and its employees, contractors, volunteers, and authorized representatives the irrevocable right and permission to:

  • Take photographs, video, audio recordings, and other media of me (or my minor child) during FundedYouth programs, classes, sessions, competitions, events, and at the Makerspace.
  • Edit, crop, retouch, and alter the resulting media.
  • Use and publish the media in the channels described in Section 2 below, in any current or future medium, without compensation to me.
  • Use my name (or my minor child’s first name and last initial only) in captions, credits, or descriptions.

This permission includes the right to make derivative works (e.g. compilations, social media clips, course promotional materials).

FundedYouth may use the media for the following purposes:

  • On the FundedYouth website (fundedyouth.org), the Portal (portal.fundedyouth.org), and documentation site (docs.fundedyouth.org)
  • On FundedYouth social media accounts (currently Instagram and YouTube; future platforms permitted)
  • In FundedYouth newsletters and email communications sent to donors, partners, and the public
  • In printed materials including brochures, posters, donor reports, grant applications, and press materials
  • In presentations by FundedYouth staff at conferences, schools, and partnership meetings
  • In grant applications and reports to foundations, government agencies, and other funders
  • In annual reports and IRS Form 990 disclosures
  • In media coverage (newspapers, TV, podcasts, blog posts) that features FundedYouth

[ATTORNEY REVIEW] Consider whether the list should be more restrictive — e.g. excluding identifiable minors from any commercial use, excluding use after termination of program participation, or limiting social media use to FundedYouth-owned channels only.

FundedYouth will NOT:

  • Sell, license, or transfer the media to third parties for their own marketing
  • Use the media in any way that is defamatory, harassing, sexually suggestive, or otherwise harmful
  • Pair the media with content that misrepresents the Releasor’s views or character
  • Disclose home addresses, school names, or full birthdates of minors in any caption or description

I understand that I will not be compensated, financially or otherwise, for any use of the media described in this Release. The media remains the property of FundedYouth.

When media features children under 18:

  • Captions will use first name and last initial only (e.g. “Maya R.”), or general descriptions (“Grade 7 student”)
  • Identifying information (school name, neighborhood, full birthdate) will not be included
  • Media will not be paired with location data more specific than “San Diego County, California”

You may revoke this Release for future uses at any time by emailing info@fundedyouth.org with the subject line “Revoke Photo Release.” Revocation:

  • Is effective when received
  • Applies only to future uses of media not yet committed (e.g. already-printed brochures or grant applications already submitted are not affected)
  • Requires FundedYouth to use commercially reasonable efforts to remove the media from FundedYouth-controlled channels (website, social media) within [ATTORNEY REVIEW — DEFAULT 30 DAYS]
  • Cannot reach media that has already been redistributed by third parties (e.g. news coverage, screen captures by others) — FundedYouth has no power to recall those

For minor participants, the parent or legal guardian who signed this Release may revoke it. When the minor turns 18, they may revoke it themselves.

[ATTORNEY REVIEW] Many nonprofits make releases “irrevocable” or limit revocation to future uses only. Confirm the approach above is acceptable in California and aligns with what the organization can practically deliver.

FundedYouth is not required to use any media of the Releasor. We may decide for any reason not to publish particular media without obligation to the Releasor.

I release FundedYouth, its directors, officers, employees, volunteers, contractors, and agents from any claim or liability arising from the lawful use of the media as authorized by this Release, including:

  • Invasion of privacy
  • Right of publicity
  • Defamation (provided the use is not itself defamatory)
  • Copyright (FundedYouth or its photographer is the copyright owner of the media)
  • Emotional distress

This release does not apply to uses that are themselves unlawful, defamatory, or in clear violation of this Release.

This Release is in addition to, not a replacement for, the General Release Agreement, Makerspace Use Agreement, and Portal agreements. This Release survives termination of program participation, but no new media will be captured after participation ends.

This Release is governed by the laws of the State of California, including without limitation Cal. Civ. Code §3344 and §3344.1 (use of likeness).

  • Have read and understood this Release
  • Am at least 18 years old (or am signing as parent or legal guardian for a minor)
  • Have authority to grant the rights described
  • Sign voluntarily
